The Difference Between Theft, Robbery And Burglary

While all property crimes have the potential to carry serious penalties, there is a nuanced difference as to how Georgia state law views these various crimes:

  • Theft involves the stealing of someone else's property without their permission. It's the most basic of the three crimes, and can also take the form of crimes such as shoplifting, identity theft, financial transaction fraud or other forms of white collar theft. Theft could be a misdemeanor or a felony, depending on the value of the property stolen and other circumstances surrounding the incident.
  • Robbery is theft that is carried out through intimidation, force or threat of force. Because this form of theft is coupled with violent action or the threat of violent action, robbery is a felony crime — meaning you could be facing serious prison time.
  • Burglary does not necessarily have to involve theft. This is simply the act of breaking into someone else's property and committing another crime, or entering someone's property without their permission with the intent to commit a crime. While the other crime may be theft, it could also be assault or any other illegal act.
