Cocaine possession can carry large prison sentences in Georgia

Being accused of cocaine possession here in Georgia can be life-altering. There are a great many things at stake for a person when facing such charges, including his or her freedom. A possession conviction can put a person behind bars for a very long time.

This is even the case for first offenses of possession of very small amounts of cocaine. Under state law, a first offense of possessing cocaine in any amount can lead to a prison sentence of 2 to 15 years.

Sentence severity goes up from there. For example, for repeat offenses of cocaine possession, the sentencing range rises to 5 to 30 years.

And if a person is accused of possessing more than 28 grams of cocaine in Georgia, they will generally be facing cocaine trafficking charges, rather than standard possession charges. Trafficking charges carry even harsher penalties. For example, they come with large mandatory minimum prison sentences. These minimums are:

  • 10 years for 28 to 200 grams
  • 15 years for 200 to 400 grams
  • 25 years for over 400 grams

So, a person may have major concerns about his or her future and freedom when allegations of cocaine possession are leveled. It is important for individuals in this situation to understand what options they have available for protecting their freedom. What avenues could be pursued depends on the circumstances. Skilled drug crime defense lawyers can provide people facing cocaine possession charges in Georgia with explanations and guidance on what their particular situation means for their defense options.
